What does the rental contract cover and when does it take effect?
The Luxury Car Marrakesh rental contract covers exclusive use of the rented vehicle between the renter and the agency in Marrakech. It takes effect upon signature at key handover and ends at the joint return inspection report.
The contract is signed at the moment of vehicle handover, at the airport, the hotel or the Guéliz agency. A joint inspection report is drawn up and photographed by the renter and the agent before the vehicle departs.
The contract ends when the vehicle is returned, at a second joint inspection. A late return is charged one quarter of the daily rate per hour started, capped at one full day. An extension of the rental is negotiated by WhatsApp and confirmed in writing before the contract's deadline.
How do booking, payment and cancellation of the contract work?
Booking a luxury car in Marrakech requires no deposit before confirmation. Cancellation is free up to 48 hours before delivery, except when the airline cancels the flight. Past that window, 50% of the first day's rate is charged.
The balance is paid at vehicle handover, by card, bank transfer or cash in dirhams. No deposit is taken before the agency's written confirmation of the booking.
A cancellation notified more than 48 hours before delivery costs the renter nothing. A cancellation notified between 0 and 48 hours before delivery costs 50% of the first day's rental rate. A flight cancelled by the airline, documented by written confirmation, incurs no charge.

What is the renter responsible for during the contract period?
The car renter remains responsible for the fuel level, tolls and traffic fines during the rental period. The renter answers for damage recorded at the return inspection, within the limit of the 8,000 to 25,000 MAD excess.
The vehicle is returned at the same fuel level as at departure, stated on the contract. A level shortfall is charged at the fuel price of the nearest station, plus a 200 MAD service fee.
Tolls and traffic fines received during the rental period remain the renter's responsibility, including those notified after the vehicle is returned. The agency forwards a copy of any fine received to the address declared on the contract.
The excess ranges from 8,000 to 25,000 MAD depending on the vehicle rented. The full excess waiver, at 200 MAD per day, reduces the renter's liability to 0 MAD in case of damage, except for exclusions stated in the contract: tyres, rims, undercarriage, roof.

What does the rental contract prohibit?
The rental contract prohibits taking the vehicle outside Moroccan territory, including to Ceuta and Melilla. It prohibits driving on unmarked off-road tracks, subletting, commercial passenger transport, towing and driving by anyone not named on the contract.
The authorized territory is limited to Morocco. Leaving the territory, including to Ceuta and Melilla, voids the insurance coverage and makes the renter fully liable.
Driving off marked tracks and paved roads is not covered by insurance. Unmarked sand zones, including certain areas of Agafay, remain prohibited under the standard contract.
The contract also prohibits subletting the vehicle to a third party, using it for paid commercial passenger transport, and using it to tow another vehicle. Only a driver named on the contract, holding a valid licence, is authorized to drive.
- Taking the vehicle outside Moroccan territory, including to Ceuta and Melilla.
- Driving off marked tracks or on unmarked sand.
- Subletting the vehicle to a third party.
- Transporting passengers on a paid commercial basis.
- Towing another vehicle or a trailer.
- Driving without being named on the rental contract.
How are disputes settled and which law applies to the contract?
Moroccan law governs the car rental contract signed in Marrakech, regardless of the renter's nationality. The courts of Marrakech have sole jurisdiction in case of dispute. The signed contract and the joint inspection report serve as evidence between the parties.
The rental contract, drafted in French, is subject to Moroccan law for its interpretation and execution. This clause applies to Moroccan renters and foreign renters alike.
Any dispute relating to the performance of the contract falls under the exclusive jurisdiction of the courts of Marrakech. The renter keeps a signed copy of the contract and of the joint inspection report, the reference documents in case of disagreement over the vehicle's condition or the amount charged.

Frequently asked questions about the general terms of car rental in Marrakech
Six questions come up often about the car rental contract in Marrakech: extensions, late returns, the authorized territory, undeclared drivers, the excess and the applicable law. The answers below complement the clauses detailed above.
Can the rental contract be extended after signature?
Yes. An extension is requested by WhatsApp before the contract's deadline and then confirmed in writing, with the new daily rate. Without written confirmation, rental beyond the scheduled time is treated as a late return, charged per hour started.
What is the charge for a late return of the vehicle?
A late return costs one quarter of the daily rate per hour started after the time scheduled in the contract. This amount is capped at one full day of rental. Beyond 24 hours of unannounced delay, the vehicle is considered not returned and reported to the authorities.
Does the contract allow driving the vehicle outside Morocco?
No. The contract limits use of the vehicle to Moroccan territory, Ceuta and Melilla excluded. Leaving the territory, whether observed or declared, voids the insurance coverage and makes the renter fully liable for any damage or theft occurring abroad.
Can someone not named on the contract drive the rented vehicle?
No. Only drivers named on the contract, holding a licence valid for at least 2 years, are covered by insurance. An accident caused by an undeclared driver remains the renter's full responsibility, with no excess applied.
How is the excess calculated for damage recorded at return?
The excess ranges from 8,000 to 25,000 MAD depending on the vehicle rented, applied to the actual repair cost. The full excess waiver, at 200 MAD per day, reduces this liability to 0 MAD, excluding tyres, rims and undercarriage.
Does Moroccan law apply in a dispute with a foreign renter?
Yes. The contract is subject to Moroccan law and the jurisdiction of the courts of Marrakech, regardless of the renter's nationality. The signed contract and the joint inspection report serve as reference documents before any court seized of the matter.
